We are upgrading from 11 to 12 and have used the <param name="enableConsistencyCheck" value="true"/> in repository.xml for one deployment, however now that this parameter has been switched off, the consistency check is still running. How can we stop this behaviour?

The part of the repository.xml is copied over to worspaces/default/workspace.xml and the enableConsistencyCheck parameter in it is probably still “true”, so you’ll have to modify that as well.
